Gang Injunctions

Gang injunctions are powerful law enforcement tools that are used, and sometimes abused, to prevent gang members from engaging in otherwise lawful activities. This could be as simple as associating with other known gang members in certain neighborhoods. The original gang injunctions were used in Los Angeles in the 1980’s, although now the practice is more widespread, including over 150 current injunctions throughout California. Oxnard has one of the most restrictive gang injunctions. Although there have been constitutional challenges to gang injunctions, the challenges have not been successful at this time.

Mr. Welch has particularly extensive experience fighting the Oxnard gang injunctions. The two largest injunctions in Oxnard apply to the Colonia Chiques gang and the Southside Chiques. The Colonia Chiques injunction applies to more than 250 people. Unlike the four-block injunction that was reviewed by the California Supreme Court in People ex rel Gallo v Carlos Acuna, the Colonia Chiques injunction spans 6.6 miles. The Southside Chiques injunction is smaller, applying to only 66 people and covering just over 4 miles. These injunctions criminalize wearing certain attire, associating with others on the list, and staying out past 10 p.m.

However, the good news is if you or someone you love is the subject of a gang injunction, there is still hope. It is possible for those on the list to petition the court for removal. Those who are charged with violating a gang injunction also have strong defenses available.
