Proposition 36: Alternative to Jail
Eligibility for a Drug Rehab Programs After an Arrest
Proposition 36 was passed by voters in order to help drug offenders experience full rehabilitation, rather than jail. The Law Office of Christopher P. Welch has a great deal of experience assisting individuals eligible for Proposition 36.
An offender may be eligible for Proposition 36 if:
- It is their first or second offense AND
- Their use, possession, or transportation was for personal purposes rather than for sale
Proposition 36 is available for any type of illegal drug. This includes, but is not limited to:
- marijuana
- PCP
- cocaine
- methamphetamine
- heroin
- ecstasy
- prescription drugs. For marijuana, cultivation charges are also eligible.
