Carjacking Laws in California

Carjacking involves the taking of an automobile while the owner is present, either inside the vehicle or near it. This is a felony charge that can carry up to nine years in prison.

  • The prosecution must prove the following to get a conviction:
  • You obtained a vehicle not your own
  • The rightful owner was in the vicinity
  • You obtained the vehicle without permission and against the owner's wishes
  • You obtained the vehicle by use of force or intimidation
  • You did the above to intentionally deprive the owner for some amount of time

Your sentence can be enhanced if you used a firearm during the carjacking, you intentionally discharged the weapon, or the weapon injured or killed another person, resulting in an additional 10, 20, or 25 years in prison, respectively.
